For buyers / subscribers of Imagella:

This document is an agreement between you and Imagella. Please read this agreement carefully before downloading the content. By downloading any content, you agree to be bound by the terms of this agreement and the terms of use. Imagella reserves the right to change any provision of this agreement and you agree to be bound by such changes. If you do not agree to the terms of the agreement you need to refrain from downloading and use of the Content.

STANDARD RF LICENSE

1. All content on the Site is protected by international copyright laws and treaties. Imagella and various sellers of the Content, who provide the Content to Imagella, own all rights, including copyrights to the Content. These rights are not transferable to you. Your rights to use the Content are subject to this agreement and are conditioned upon your payment to Imagella for the use of the Content. If you fail to make any payment to Imagella, your account will be suspended.

2. By this agreement Imagella grants you personal, non-exclusive rights to use and reproduce the Content in the following ways:

For images:

• corporate printing - up to 7,000 copies, not for sale;


• editorial use (registered mass media): 1 printed edition, 1 TV show or 1 web-site;


• private interior: 1 copy for apartment or house design.

For videos:

• editorial use (registered mass media), 1 TV show or 1 web-site

3. In the event that you create a derivative work based on the Content, all rights to the Content shall continue to be owned by Imagella and suppliers (sellers) of the Content.

STANDARD RF LICENSE - RESTRICTIONS

You may not:

5. Use the Content other than as specified in the rules of Standard RF license.

6. Use the Content on websites or in connection with any service designed to sell or induce sales.

7. Use the Content together with pornographic, defamatory, or otherwise unlawful content.

8. Use the Content for advertisement of alcohol, tobacco, drugs or pharmaceutical products.

9. Resell or redistribute any Content.

10. Use the Content in a manner that a subscriber/buyer would compete with Imagella.

11. Use the Content as a trademark or a logo.

12. Use automated programs to access the Imagella website.

ENHANCED RF LICENSE

Restrictions imposed by Standard RF license are lifted and you are granted a personal, non exclusive right to the described above types of use and reproduction of the Content.

Editorial Licen



The Editorial Section includes images that reflect different events from social, cultural and political scenes. Images downloaded from the Editorial section of our site, along with images downloaded with our Royalty Free license, can be used within editorial context as long as the Terms of Use are met.



The high-resolution images that you download under the Editorial License may be disseminated in printed or electronic media outlets, and they may be used to illustrate truthful articles or broadcasts appearing in magazines, newspapers or any other editorial context. Please note that when you purchase the high-resolution image (i.e. under the Editorial License), it does not transfer you any copyright to this image. You may not claim that the image is yours and you may not sell it, license for use, or in any way circulate the image.



There are also special ethical considerations that must be taken into account. When using or submitting editorial images, you are solely responsible for any claims related to or arising from any visual adjustments of the images. Standard manipulation such as cropping the image or regular brightness/contrast corrections are allowed only if these actions will not harm the visual message of the image. We take the right to refuse the submission of any image that we consider as not marketable.



Additional requirements for buyers:

Images displayed in the editorial section may include visible logos, or identifiable persons who didn’t sign a model release document. You are solely responsible for the usage given to such images. Please note that editorial images are in no way meant to be used for commercial purposes and using them in a commercial context is totally against the Editorial Terms.



Additional requirements for contributors:

Please remember that Editorial images shall not have biased or misleading nature and shall be as objective as possible. Therefore, any post-processing of the photographs that might damage or distort the reality as seen through your camera lens will not be tolerated. You are allowed to crop an image and make a standard brightness/contrast adjustment. However, the use of clone, brushes and/or artistic filters are not allowed for editorial images.



You hereby agree that the image submitted to Imagella is not obtained in unlawful ways or that can enforce civil or criminal liabilities. You are solely responsible for how the image is produced and your activities will indemnify Imagella harmless of any claims from you or any third parties involved within the shooting.
